NOTICE PURSUANT TO ARTICLES 12 ET SEQ. OF EU REGULATION 2016/679 REGARDING THE PROCESSING OF PERSONAL DATA

NETMETRIX S.R.L. (hereinafter, “the Company”), with registered office at Via Emilio Salgari, 17 – 41123 Modena, Italy, owner of the website https://www.netmetrixgroup.com/ (hereinafter, the "Website"), provides the following privacy notice pursuant to Article 13 of EU Regulation 2016/679 of April 27, 2016, in its capacity as Data Controller of personal data voluntarily provided by users through the data collection forms on the Website (hereinafter, the "Users").

 

The Company places the utmost importance on the right to privacy and the protection of personal data of its Users. For any information regarding this privacy notice, Users can contact NETMETRIX S.R.L. at any time using the contact details listed in Section 8 below.

 

The Company may modify this privacy policy based on legal or regulatory requirements, or in order to comply with instructions issued by competent authorities. Users are therefore encouraged to check it periodically.

Specifically, the Company provides the following information:

 

1. CATEGORIES OF DATA

Browsing Data
The computer systems and software procedures used to operate the Website acquire certain personal data during normal operation, the transmission of which is implicit in the use of Internet communication protocols. These are not collected to be associated with identified individuals, but by their very nature could, through processing and association with data held by third parties, allow users to be identified.

This category includes IP addresses or domain names of the computers used by users connecting to the Website, URI (Uniform Resource Identifier) addresses of requested resources, time of request, method used to submit the request to the server, size of the file obtained, numeric code indicating the status of the server’s response (success, error, etc.), and other parameters related to the user’s operating system and IT environment. These data are used solely to obtain anonymous statistical information about Website use and to check its proper functioning. They may also be used to determine responsibility in the event of possible cybercrimes against the Website. Except for this case, web contact data are retained for a limited time and are periodically deleted.

 

Data Voluntarily Provided by the User
The data subject may voluntarily provide information necessary to deliver services by completing the data collection forms on the Website or by sending emails to the indicated address.
Data collected may include general identification information (e.g., name, surname, physical and/or electronic and/or telephone contact details). The Data Controller does not collect or process “special categories of personal data” as defined by Article 9 of the GDPR (such as health-related information).

 

Cookies
The Website uses cookies in certain areas. Cookies are files that store information on a user’s hard drive or browser cache. They allow the Website to determine if a user has previously visited, load custom settings/preferences (e.g., language, screen resolution), and collect usage statistics (e.g., most visited pages, time spent on the Website). This improves navigation and user experience. For example, cookies ensure that future visits reflect the user’s saved preferences.

 

2. PURPOSE AND LEGAL BASIS OF PROCESSING

 

Processing will also be carried out using electronic tools for the following purposes:

(e.g., preparing quotes; sending or requesting commercial offers; requesting products; providing pre- and post-sale assistance or consulting).


Data collected for this purpose will be processed without requiring explicit consent under Article 6(1)(b) and (c) of the GDPR, as necessary to fulfill contractual or pre-contractual obligations and legal requirements.

b. Sending of informational/promotional communications and advertising materials, offers of products and/or services (own or third-party), customer satisfaction surveys, and market research through all means, including telephone with an operator and/or automated systems (e.g., SMS, MMS, fax, auto-responders, push notifications, social media).
Data for these purposes will be processed only with the data subject’s prior and explicit consent in accordance with Article 6(1)(a) of the GDPR.

 

3. NATURE OF DATA PROVISION

Providing personal data for the purposes outlined in Section 2(a) is mandatory. Failure to do so will prevent us from providing the requested service.
For the purposes outlined in Section 2(b), the user must freely consent to processing. Consent may be withdrawn at any time.

 

4. METHODS OF PROCESSING AND DATA RETENTION

Data are collected, processed, and stored primarily in digital, electronic, or telematic form. Processing is carried out by authorized personnel following formal appointments and appropriate training in security measures and procedures.
The data subject will not be subject to any decision based solely on automated processing, including profiling, which may produce legal or significant effects on them.

Personal data are retained only for as long as necessary to fulfill the purposes for which they were collected, in accordance with the minimization principle under Article 5(1)(c) of the GDPR. Since the service is ongoing, data will be processed until the service is deactivated or canceled by the user, except where legal obligations (e.g., fiscal or administrative) require longer retention.

 

5. DATA DISCLOSURE

Your data may be disclosed to:

a. Consultants (e.g., tax, IT service providers) specifically authorized for processing;

b. Public authorities, if required by law;

c. Companies that provide services to the Data Controller to support its business activities.

A list of Data Processors is available upon request from the Data Controller (see Section 8).

Your personal data will not be shared with unauthorized parties, nor made publicly accessible or disclosed to unspecified entities.

 

6. TRANSFER OF DATA ABROAD

User-provided data may be transferred outside of Italy to companies within the categories mentioned in Section 5, provided they are located within the European Union. Third-party cookie regulations remain subject to the terms stated in this policy.
